El acusado está imputado por “enriquecimiento ilícito y tenencia de armas”.
De esta manera, vería su pena completada el 14 de diciembre de 2023 tras la unificación con la pena a la que se lo condenó por el arma hallada en junio de 2016. Por otro lado, también se ratificó la multa del 60% del valor del enriquecimiento y la inhabilitación absoluta perpetua para ocupar cargos públicos.
A su vez, se le ratificó el decomiso de 8.982.047 dólares, 153.610 euros y 159.114 pesos que ya fueron entregados a los hospitales Ricardo Gutiérrez y Garrahan.
Además del dinero en efectivo, López también se benefició patrimonialmente de manera ilegal con la posesión de una casa en la localidad de Dique Luján, Partido de Tigre, mediante la utilización de los empresarios Galera y Gutiérrez como testaferros.
Por otro lado, el fallo lamentó que no siguiera el avance de la trazabilidad del dinero ya que solo se pudo determinar que una acotada parte del monto venía de una entidad bancaria localizada en Nueva York. La misma llegó a las manos del exfuncioario a través del Banco Finansur, por lo que se cuestionó “el exiguo impulso de la instrucción para profundizar la pista de quien o quienes estuvieron detrás de la entrega”.
