El gobernador Axel Kicillof enviará en los próximos días a la Legislatura un proyecto de ley para implementar una nueva reforma de la caja de jubilaciones del Banco Provincia, que desanda algunos de los cambios implementados durante la gestión de su antecesora, María Eugenia Vidal en 2017.
El proyecto ya está listo y aun-que sus detalles se mantienen en reserva, DIB pudo saber que aunque no para volver al esquema previo a la reforma de Vidal, sí busca avanzar en una especie de vía intermedia que devuelva a los jubilados del Banco algunos beneficios que perdieron, aunque sin comprometer la sostenibilidad del sistema.
La reforma estableció una suba escalonada y gradual de la edad jubilatoria -pasó de 60 a 65 años- y una fórmula de cálculo menos favorable a los pasivos. Fue un recorte profundo, que se aprobó en medio de un escándalo que incluyó la quema de un acceso al palacio legislativo y la irrupción en el recinto de sesiones de Diputados de manifestantes comandados por el intendente de Ensenada, Mario Secco, quien enfrenta una causa que está por ser elevada a juicio por el episodio. Otros sectores del peronismo, hoy en el Frente de Todos, lo apoyaron.
Vidal promulgó rápidamente los cambios, pero el esquema fue judicializado casi de inmediato también y viene sufriendo reveses en tribunales de primera y segunda instancia de varios distritos de la provincia, que disponen que los jubilados que los impulsan cobren de acuerdo con la fórmula previa, lo que genera un costo adicional para el Estado bonaerense, que además debe correr con las costas. Pero el dato decisivo, en este plano, es una demanda por inconstitucionalidad que está en la Corte Suprema, y que fue planteada por un colectivo de actores. Un fallo adverso podría tener efectos más generales y es por lo tanto un riesgo latente alto para la administración Kicillof.
En el Gobierno lo consideran un asunto económico de magnitud: el peso de la caja jubilatoria del banco es grande. De hecho, comparten parte del diagnóstico que llevó a Vidal a ajustar su funcionamiento para poner coto a un déficit que, cuando se hizo aquella reforma, era de unos $ 6.000 millones. “La caja tiene que ser sustentable”, dicen.
La diferencia es que para lograr esa solución plantean una menos cruenta para los trabajadores y que no genere un problema económico judicial. Una especie de vía intermedia entre lo que existía antes de Vidal y lo que existe ahora. Hay un dato clave: la buena relación de Kicillof con el secretario general de La Bancaria, Sergio Palazzo. El gobernador conversó el tema con él el 23 de junio pasado, cuando participó del 48 congreso de ese gremio. Durante la elaboración de la iniciativa, los técnicos al comando del Federico Thea, el secretario general de la gobernación, trabajaron en sintonía con el gremio y Palazzo le habría dado el visto bueno.
En la Legislatura, el proyecto será un expediente caliente. La prueba ácida será para el oficialismo, lo que ocurra en Senadores, la cámara con mayoría de Juntos por el Cambio donde a Kicillof toda negociación le cuesta el triple. En el oficialismo confían que un dato judicial los ayude: El procurador de la Corte, Julio Conte Grand, emitió un dictamen sobre la causa que está en la Corte en el que se pronuncia a favor de la inconstitucionalidad de la ley jubilatoria vigente, la 15008.
