La Ley 27.521 rige para quienes comercializan vestimenta nacional o importada, de manera presencial o por medios electrónicos. La norma fue sancionada hace más de un año y medio en la Cámara de Diputados.
El gobierno nacional reglamentó la Ley de Talles, que establece un sistema único normalizado de identificación de talles de indumentaria en todo el país a través de un decreto publicado este miércoles en Boletín Oficial
El Sistema Único Normalizado de Identificación de Talles de Indumentaria (Suniti), la Ley 27.521, rige para quienes comercializan vestimenta nacional o importada, de manera presencial o por medios electrónicos.
A más de un año y medio de su sanción en la Cámara de Diputados, en el Sistema se encontrarán incluidos además el calzado y los uniformes de trabajo, de acuerdo al decreto 375/2021 conocido este miércoles.
La normativa aclara que dicho sistema deberá ser implementado para la totalidad de la indumentaria, “salvo aquellas prendas expresamente excluidas”.
En efecto, se excluyó la indumentaria denominada de alta costura o de diseño de autor; las prendas confeccionadas a medida y, en general, aquellas que se hayan realizado de manera personalizada a pedido de consumidoras y consumidores; los accesorios de vestir (corbatas, bufandas, pañuelos, medias, guantes y sombreros, entre otros) y los implementos destinados a la protección personal en tareas laborales.
El objetivo es generar “el acceso a información unívoca en materia de talles de indumentaria”, resaltó el decreto.
El Poder Ejecutivo determinó además que “será considerado acto discriminatorio cualquier práctica abusiva, vejatoria o estigmatizante referida al aspecto físico, género, orientación sexual, identidad de género u otra característica de las consumidoras y los consumidores”.

Según el texto oficial, “la falta de la estandarización en el sistema de identificación de talles de indumentaria es una problemática que tiene repercusión no solo en los distintos sectores dedicados a la fabricación, confección, comercialización e importación de estos productos sino, fundamentalmente, afecta el interés de las consumidoras y los consumidores”.
“Esta temática cobró una significativa importancia en la agenda nacional con el auge del comercio electrónico, circunstancia que se ha visto potenciada durante la pandemia del Covid-19”, añadió el decreto.
Cómo se establecerán los talles
En cuanto al estudio antropométrico mediante el cual se establecerán las medidas corporales estandarizadas, se dispuso que el Instituto Nacional de Tecnología Industrial (INTI) será el encargado de realizarlo dentro del plazo de 240 días.
De acuerdo con lo dispuesto, la Secretaría de Comercio Interior será la autoridad de aplicación de la Ley y en tal carácter estará facultada para dictar las normas complementarias y/o aclaratorias que resulten necesarias para su efectiva aplicación.
Asimismo, se creó el “Consejo Técnico Consultivo del Sistema Único Normalizado de Identificación de Talles de Indumentaria”, cuya función será examinar y pronunciarse, a pedido de la autoridad de aplicación, sobre cuestiones referentes a la implementación y difusión de ese sistema, sin efecto vinculante.
El Consejo “no implicará erogación adicional alguna para el Estado Nacional”, aclaró el Gobierno, y puntualizó que estará conformado por representantes de la Secretaría de Comercio Interior, de las cámaras sectoriales, de organizaciones de la sociedad civil vinculadas a la temática; un representante de los profesores regulares de las Universidades Nacionales de la carrera de Diseño de Indumentaria y Diseño Textil, un representante del Ministerio de Salud, del Inadi y del INTI.
